Terms of Service

Welcome to Awayt! These Terms of Service ("Terms") govern your use of the Awayt app ("App") and website awayt.fun ("Service"). By using Awayt, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Awayt, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
2. Eligibility
Awayt is rated 9+ due to user-generated text content. You must be at least 9 years old to use this Service. If you are under 13, you may only use the Service with parental consent.
3. Account & Registration
Awayt uses anonymous authentication — no email, name, or personal information required. However, you are responsible for:
- Maintaining access to your device (your anonymous ID is device-specific)
- Restoring Premium purchases via Apple StoreKit if you reinstall the app
- Keeping your countdown links secure (anyone with the link can view shared countdowns)
4. User Content & Conduct
You may create countdowns with titles, notes, emoji, and polls. You agree NOT to create content that:
- Contains hate speech, harassment, or discrimination
- Promotes violence, self-harm, or illegal activities
- Includes sexually explicit or adult content
- Infringes on copyright, trademark, or intellectual property rights
- Spams, scams, or misleads other users
- Impersonates any person, organization, or brand
Content Moderation: Awayt uses client-side keyword filters to block inappropriate text before submission. We also provide an in-app reporting system. We reserve the right to remove any content that violates these Terms without notice.
5. Shared Countdowns
When you create a shared countdown:
- Anyone with the link can view your countdown (this is intentional for sharing)
- You cannot control who re-shares your link
- Do not share personal, sensitive, or private information in countdown titles or notes
- You can delete your countdown anytime — data is permanently removed from public view
6. Premium Subscriptions
Awayt Premium is an optional subscription with the following terms:
- Price: Launch special $1.99/year, then $4.99/year (prices may vary by region)
- Billing: Charged to your Apple ID account at confirmation of purchase
- Renewal: Automatically renews annually unless cancelled at least 24 hours before the end of the current period
- Cancellation: Cancel anytime in iOS Settings → Subscriptions. No refunds for partial subscription periods.
- Free Trial: Not available at launch (may be added in future updates)
- Restore: Use "Restore Purchases" in the app if you reinstall or change devices

8. Intellectual Property
Awayt and its content (excluding user-generated content) are owned by Awayt and protected by copyright, trademark, and other laws. You may not:
- Copy, modify, or distribute Awayt's code or design
- Use Awayt's name, logo, or branding without permission
- Reverse engineer, decompile, or disassemble the App
9. Third-Party Services
Awayt uses the following third-party services:
- Supabase (supabase.com) — Database and storage, hosted in EU (Frankfurt)
- Apple App Store — In-app purchase processing
- ip-api.com — Coarse location lookup (country-level analytics only)
These services have their own terms and privacy policies. We are not responsible for their practices.
10. Disclaimers & Limitation of Liability
Awayt is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- That countdowns will always sync in real-time
- That push notifications will always be delivered
To the maximum extent permitted by law, Awayt is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
11. Termination
We may suspend or terminate your access to Awayt if you violate these Terms. You may stop using the Service at any time by deleting the app and your countdowns.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the app or by updating the "Last updated" date above. Continued use after changes constitutes acceptance.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles.
For users in Turkey: Any disputes arising from these Terms shall be resolved exclusively in the courts of İzmir, Turkey.
For users in the European Union, United Kingdom, or other regions with mandatory consumer protection laws: Nothing in these Terms affects your statutory rights as a consumer under applicable local law. You may bring claims in your local jurisdiction where required by mandatory consumer protection regulations.
For all other international users: We encourage resolving disputes amicably by contacting us at hi@awayt.fun. If legal action is necessary, the courts of İzmir, Turkey shall have jurisdiction, unless prohibited by your local mandatory laws.

15. Apple-Specific Terms
The following terms apply to Awayt as distributed through the Apple App Store:
- You acknowledge that Apple is not a party to these Terms and has no obligation to provide maintenance or support
- In the event of any failure of the App to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if applicable)
- Apple has no other warranty obligation whatsoever with respect to the App
- Apple is not responsible for investigating claims related to your use of the App
- Apple is not responsible for product liability claims related to the App
- If a third party claims that the App infringes their intellectual property, Apple will not be responsible for investigation or defense
